crash. one person suffered serious injuried. morales attorney called the crash a tragic accident. >> my condolences to the family. this is a tragedy for the two people that died and the one that was seriously hurt. >> reporter: police say morales is a known gang member but have not disclosed his criminal records. police have set bail at $10 million. a san francisco man is behind bars facing attempted murder charges. he's accused of dousing his girlfriend with gasoline then setting her on fire. police arrested 22-year-old dexter oliver at an oakland motel last night. oliver's boyfriend star lamra remained at the burn unit in st. francis hospital in critical condition. antioch police are searching for four men. police say the suspects were all in their 20s that they rushed into the shell station on loan treeway about 3:30 this morning. what they were after was beer and you can see some of the broken bodless there in the parking lot. the clerk tried to stop them and that's when the four men beat him up. police say the men didn't take

any money, they only made off with the beer. we told you yesterday here at 5:00 how the fbi is taking over the search of remains of victims of the speed killers. and today ken pritchett is live with why the fbi may be taking over that case. >> reporter: early last year shermantine threw out this map and pointed at this area. where the fbi is digging right now is not in that exact same location but they say it may not matter. it was not expected that the fbi would find anything today it could take weeks to hit bottom. it is unclear if there are any remains in this well. the victims of death row inmate wesley shermantine and the now

deceased herzog. >> this is where wesley told us in march of last year where to dig. >> reporter: leonard padilla and ron dick have been in contact with shermantine who provided them this map. >> as far as places to dig in that area, there's probably 20 to 30 wells and i bet you you can find a body down in any well. >> reporter: police believe shermantine and herzog killed dozens of people in the 90s. two women were identified. that well was about a half a mile west on flood road of the new well that the fbi began excavating yesterday morning. but on shermantine's map he pointed to a well he says contains numerous remains a well west of a small bridge. a different well from where the fbi is now digging. but both bounty hunters say it shouldn't matter. >> there was a phrase that was said they were filling up with bodies so much that they had to

keep going to different wells. so i think pretty wherever you throw a shovel you're going to be okay. >> reporter: right now you should see a live view from a chopper above the dig site where the fbi is still excavating, according to the fbi by the end of operations today when the sun goes down, they expected to have about a 10-foot deep hole there as part of their site preparations. they expect those site preparations to continue tomorrow and that the sifting out the dirt by hand, the actual investigation to begin shortly thereafter. near linden, ken pritchett. today governor jerry brown spoke publicly for the first time about his prostate cancer diagnosis and his long term outlook. >> i'm ready to go, and don't expect me to leave too soon. >> the governor said he has completed radiation treatments for what doctors say was

localized early stage prostate cancer. the 74-year-old governor underwent treatment during the holidays and both the governor and his doctors say his prognosis is good. what's being called a significant plumbing problem left an entire hospital in berkeley without water this afternoon. the code orange situation began about 1:00 this afternoon at alta base hospital. bottled water was handed out to patients and staff but some patients were calling the ktvu newsroom complaining that they didn't have water to irrigate wounds. some surgeries were also postponed. crews were seen digging outside but it's not clear what caused the problem. it is supposed to be fixed though by right about now. investigators say the petaluma teen found dead in south tahoe appears to have taken off her ski jacket and became disoriented while walking. alyssa byrne was found last friday. she had attempted to walk in

freezing weather to a hotel in state line nevada. at this point they'll try to determine if drugs or alcohol were a factor in her death. a spokesman for the oakland unified district says it will be at least a week until their district building reopened after there had been a flood there. someone accidentally left a tap on in a custodian closet overnight. the flood caused cig -- significant damage and most employees will be working from home for the rest of the week. there was a glimmer of hope this morning for a gay boy scout who's trying to earn his eagle scout rank. it's a story that has gained a

lot of attention. >> reporter: ryan andresin put up this tolerance wall. but today he found out he will not be achieving his goal and there are no appeals left. hundreds of people signed this petition asking the boys of america to allow an openly gay teen to reach the goal of eagle scout. >> this is ridiculous. >> reporter: ryan's application was -- four people on the board signed ryan's application, his family and supporters thought they had won. >> we were told last week that the council was going to approve this and send this on. >> reporter: but this morning his family found out they would not receive the votes needed.

guide ships in and out of the bay are certainly skilled. big ships must hire them and bar pilots are indemnified for responsibility. >> we have a gps system so we have our own information. >> reporter: we learned captain clese has 1,100 trips in the bay. they work seven days on, seven off and earn $150,000 a year. >> i think people would be shocked how little they work for how much money they make and that we still have incidents and we still can't help police ourselves. >> reporter: the shipping association sued the bar pilot's commission last summer demanding release of pilot logs. the court agreed but bar pilots have now appealed telling me

late today that the data are private and personal. they also declined an on camera interview. reporting live health and science editor john fowler, ktvu news. state inspectors are looking at what led to an accident which killed an employee at a textile department. a 56-year-old man was killed when a big rig hit him while backing up to a dock. the state division of occupational safety is currently investigating that accident. the santa clara county coroner identified a woman who drowned driving into a pond on sunday as 69-year-old mayra marsh. the highway patrol says the san jose woman lost control of her car as she turned from the almond expressway toward a ramp to state highway 85. they are currently investigating why she lost control. bystanders and emergency crewed tried to get to her as soon as they could but unfortunately it

was too late. stanley arnold and nicholas gears both face felony charges in connection with the robbery of a couple in milpitas january 2nd on south main street. the robbers stole the couples wallets and cell phones at gunpoint. officers say within an hour of the heist they arrested the pair and recovered the stolen items along with a loaded gun. gut wrenching 911 calls were played today during a preliminary hearing of the man accused of killing 12 people inside a colorado movie theater. distraught relatives lined up early for today's proceedings. prosecutors are presenting evidence in their effort to bring 18-year-old james holmes to trial. today they played 911 calls where you could hear people crying for help while there was gunfire going off in the back ground. in one call you could hear 27 shots fired. despite the drama the accused gunman continued to show no reaction. >> he has no emotion. like i said before, i don't know. it's really hard to express. it's like a robot.

>> reporter: prosecutors also described the gunman's booby trapped apartment. they had a boom box set to play loud music to attract a person to the outside of his apartment. the remote was hooked up to explosive contraptions inside his apartment including improvised nay palm. the city of newtown connecticut is getting help with their bills. the state of connecticut is giving a half million dollars to businesses in the towns that have lost money because of the fall out from last month's deadly school shooting. as many as 16 businesses were essentially shut down for nearly two weeks by a crush of traffic in that normally quiet town. a study find that a small amount of drivers are responsible for large amounts

today schools in ohio were placed on lock down following a threat of a shooting. one of those activists spoke exclusively with scott mcfarlane about a new federal

investigation. >> reporter: the rest of the nation began watching as a group of masked online activists circulated video of the graduate of a high school laughing about the rape. they helped spread a photo of the alleged victim of the rape. >> the picture of the girl from the party, the videos, that you refer to and that have already been made public. that may be something that hurts the victim more. that may be painful for her family. any regrets that bringing so much attention to this causes a backfire, a backlash against the victim. >> normally i would agree with you. but we've been in contact with the victim through her best friend who is constantly with her. we prefer like a third party contact with her. she felt it was being swept under the rug as well and justice was not going to be served. >> reporter: a petition to get

the heaviest locations so that's not much. over all chilly but not as cold as it's going to be tomorrow night and into tomorrow morning. tomorrow then look for increasing clouds. some sprinkles possible. the computer model will bare that out. we're looking for a few sprinkles to show up perhaps in the afternoon hours. the bay area forecast calls for a chance of afternoon showers. this is the system. not that much to it. it goes on but now the cold air is here because remember i said the front. when the front goes through the cold airlines up behind that. now the cold air is in. starts to clear a little bit. just some clouds but it's clearing. and you're going to get very, very cold air. very cold temperatures thursday and friday morning. easily see a freeze warning or freeze advisory or some kind of a product from the national weather center denoting that the cold temperatures for thursday and friday morning. if you have agricultural interest any where in the bay area, or pets or livestock it's going to be very cold in those inland bay valleys in and around the bay. these are the forecasts
